Last night I posted a question whether anyone with mental health issues could ever be awarded more than 4 points under activity 11, planning and following journeys. This was highlighted in the links you gave me to the DWP PIP guidelines for providers, dated 31/10/14.

I am pleased to say that at a Tribunal today my client was awarded 10 points under 11 (d), purely on the grounds of mental health.

His Daily Living assessment was also increased from 4 points to 19.

A representative from the DWP was also present and I was informed that this is now their policy for every PIP appeal.

That's great news! I would like to think that the tide is turning, but it is far too early for that.

The DWP are closely following the first 100, 200, we're not sure how many exactly PIP Tribunals, I think the likelihood of Presenting Officers will reduce as the number of appeals heard increases.

I have to warn you that they are also requesting a Statement of Reasons for many of the PIP appeals that they have lost, and as this is a controversial area of the benefit, I think it likely that this will be one of them. This could delay the payment of any increased award until they have made a Decision on whether they can take it further

It also seems that The DWP may be requesting Statements of Reasons (S of R) for successful FTT PIP appeals, as seen on rightsnet :

As you probably know, they have one month from the date of the Decision Notice to request an S of R.

You will soon know if they have, as you and/or your client will also receive a copy of The S of R.

I think you are right about that. The Tribunal offered every opportunity to the DWP representative to offer counter arguments but nothing happened.
