Permitted Work Queries – ESA – CR to IR / 12 Month was created by persona1973

Thanks for all your previous help and advice on this forum – it has been invaluable.
I wonder if anyone knew of this regarding income related ESA versus contribution based ESA.
Essentially when you are receiving contribution related ESA and it changes after a year to income related ESA, do any permitted work earnings then count against your income related ESA with a disregard of £20 – can anyone confirm this? Thanks in advance for this
See I have been receiving conflicting advice on this, and have also been told that your permitted work earnings are exempt from income related esa for the first twelve months (ie your benefits would stay at the same level)
I have also been told that it would be after 12 months that the permitted work disregard would come in – would this mean that one is able to carry on with the permitted work after 12 months and remain on ESA IR with a 20 pound disregard on earnings
Thanks in advance to anyone who can help clarify this.

There are actually a number of separate issues.
Permitted Work is classed as Exempt Work, so is fully disregarded for both Contribution and Income Related ESA.
The 365 day time limit for ESA(CB) only applies to claimants not in the Support Group, if you are in the SG then your payments will continue.
Permitted Work at the Upper Limit, above £20/week and below £102/week and less than 16 hours per week, can only be performed for 12 months from the first date that the PW is done unless you are in the SG. Continuing beyond the 12 months will result in the claimants ESA claim being closed.
There is no time limit for the Lower Limit, below £20/week.
