Hi I have now been given the date for my ESA tribunal appeal, which is to be held on 18th October, my local citizens advice has passed my papers to FRU but looking on their website they do not do representations on a Saturday. Will it be Ok for my daughter to represent me.

Since sending in my appeal papers I have attended pain management clinic twice, so have 2 letters from the consultant I see + an additional to whom it may concern letter regarding my health, am I allowed to use this as additional evidence if so should I send it in advance or just take it with me to the tribunal & present on the day.

Your daughter can act as your representative (small r) but I would not put her forward as a Representative (capital R) as the panel will assume responsibilities of her that she will not be able to fulfil. She can provide moral support and can provide testimony if it is appropriate, she should be given an opportunity before the end of the hearing to speak.

You can use this new evidence, but only if it clearly refers to your condition as it was at the time of the assessment, if it does not make any such reference or is connection with changes in your condition that occurred after the assessment then I would expect it to be excluded.
