Hi, At last my decision came to-day awarded standard rate pip for mobility & daily living! What a relief it is however I am going to ask for a mandatory reconsideration as I told them that I am living downstairs on the sofa as I cannot climb the stairs and they have not mentioned this (The stairs) in the decision makers reasoning although they have said " I agree an aid such as a step, grab rail and bath seat will assist and support you to wash and bathe" How can I achieve this if I cannot climb the stairs! They also stated that I said at my assessment that "I was unable to stand for long however the use of an aid such as perching stool would help" I never mentioned anything about a perching stool nor did the assessor mention a perching stool, I told them that I did not cook a meal as I can not stand for more than a few minutes because of the severe pain and that I had already had a fall at the cooker and scalded myself as my knees give way without warning, so I no longer cook because of the danger I could be in. I also told them that I have someone come in 7 days a week to cook an evening meal and that my daughter calls every day to help with my dressing and makes me a sandwich for me to have at lunch time....Your thoughts on how I should approach all these factors would be most helpful, not forgetting a big thank you for all your help so far! Please be aware that the DWP and a Tribunal panel are entitled to review your claim in full when they look at it again!
The DWP are entitled to assume the use of aids if it is reasonable for them to do so, so looking at your ability to cook; you say that you can stand to prepare and cook a meal, but have you shown that you cannot do so while sitting or perching on a suitable stool or chair, and why this would be the case?
From your post, using the stairs should be more obvious, if the facilities they are suggesting you use are upstairs and you cannot climb the stairs then they should not considering their use, but have you done a good enough job of showing that you cannot climb the stairs in the first place? The PIP form does not make any enquiry as to a claimants ability to use the stairs so it would be easy for any comment you have made to be overlooked.
