New Pilot Program ESA (wrag group) was created by Homer88
Hi
Quick background. Was found fit for work, did MR. Last wensday got call put into wrag ( not what was wanted). Am thinking of appealing.
while all this time was happening broke ankle, new claim for esa. Had to see advisor at JCP.
Every time I saw her got a new appoint or 2.
My MR letter arrived monday, already had appointment to see JCP advisor. She asked if I had my MR yet(she knowing the result), I said yes. She now tells me I've been mandated to a trial program .
letter heading
You have been referred to the following Opportunity: HCP ESA 18-24 PROG PILOT.
Its with a company called Ingeus UK LTD
Acording to the paperwork I have, I have to see an Health care Provider and it could last for 104 week " participation in the trail will end if you move out of the trial area or move to a different benefit or find work" which sounds like until you leave one way or another.
It also says "Allocation is completely random". It seem setup to me.
They can call me even thought I don't want them to. I have to tell them about my health condition etc ie like atos and dwp said there report was "rubbish"
Is there anything I can do, I don't trust JCP or companys that work for them.
If I appeal to the court, do I still have to go to this pilot ?

Nothing on this board constitutes legal advice - always consult a professional about specific problems

The first thing to do is to check whether this referral is mandatory or not, if it is then you have to attend unless you can show that your doing so would be contrary to the limitations you stated on your latest ESA50, in which case you need to raise the referral with your JC+ advisor on the basis that they have not taken adequate notice of the limitations resulting from your conditions.
Failing to attend a mandated Work Related Activity can and probably will result in the sanctioning of your benefit and a reduction is your weekly payments, sanctions remain in force until the missed activity is completed.

Yes i was told, and it in the paper work including a letter about sanctions.
The JCP does not know my condition, They are told not to ask ( in the paper over a week ago ). I did say to her my condition has got worst since starting to see her. They don't care !!!!!
spining plates, non targets etc. I won't complain, she get credit points..!!!

Raise your concerns in writing (or email) with your advisor, it is easy for conversations to be ignored or denied, they have to respond to a written communication.
