Can anyone please give me some advice.... I was put on ESA earlier this year in the WRAG. I have dutifully attended all my job centre interviews, except one when I phoned to say I could not make it as I was too unwell. I can only get there when my partner is able to drop me off and pick me up. I have been given a mandatory task of meeting someone who can help me update my computer skills. I have MS and find the whole thing stressful as at nearly 60 I can never see myself fit for work as I never know which days I am not going to be in pain or fatigued or both. I asked the Job Centre if they knew someone then who would employ me on the days I feel relatively well,, but it gets ignored. I get the impression the whole process is a box ticking exercise with targets to meet. My doctor says I should apply for PIP and I have the forms here. I really want to appeal the decision of being put in the WRAG group and wonder should I do this right away while I get the PIP forms filled in which need to be back by the 27th of this month. I have no idea what will happen if I appeal, I have read about the reconsideration but will this stop my benefit ? I thought being in WRAG was them just keeping an eye on you as it was explained to me it was really benefits with check ins at the Job Centre. I really feel I should be in the Support Group and want to approach all this in the right way.
Thanks in advance if anyone could give me some advice or share their experiences with me.

As I understand it from your previous posts you were moved from IB to ESA about 4 months ago, so although you are outside the limits for a normal appeal you can still make a Late Appeal.

The first thing you need to consider is whether you meet any of the Support Group Descriptors

Qualifying for the Support Group

If you think that you do then the first stage to your appeal is for you to request a Mandatory Reconsideration from the DWP, you should make the request in writing and you will need to include an explanation of why you are making the request late.

You will continue to receive the WRAG rate while this process continues, subject to the 365 day limit.

I am afraid that while you remain in the WRAG you are required to participate in Work Related Activity, your appealing will not change this although it should prevent you being forwarded to the Work Programme.

Have a look at our ESA MR & Appeal guide for more details

www.benefitsandwork.co.uk/help-for-claimants/esa

and the following factsheet

Disability Rights UK Factsheet - Appeals and reconsiderations

if you have any questions on the above, please reply to this post and we will do our best to help.

Thank you Gordon, will read up on all of that. Shall I carry on and fill in my PIP application and get it sent off by the time limit.

Your PIP application and any challenge you make against your ESA award are completely separate, providing you can cope with both activities at the same time their should be no issue.

It is essential that your PIP form is returned to the DWP by the required date otherwise you risk your claim being closed and having to start again.
