Just a quick personal update, no sign of the dreaded brown envelope, even though it is overdue, I do have a fab contact at the JC and rang them to give a personal health update, and asked the obvious question are all WCA's still suspended? answer, yes, i would not expect you to be contacted till 2015, not sure if this helps anyone and wonder if anyone else is due around this time, and if they have heard anything. Good to share
Best wishes to everyone and especially the fab mods who tirelessly help us all morning, noon and night

Hi Sh,
I am personally aware of two ESA SG recipients who are about to enter their 4th year of what was originally a 2 year prognosis.
So their ESA50's are both well overdue !!!

I have today had a client contact me informing me he is still awaiting the ATOS medical, therefore still in receipt of the basic rate of benefit, awaiting to be placed into one of the groups. As he is in receipt of contribution based ESA this is due to stop some time in November as he will have reached the 52 week limit.
His partner works therefore he will not receive any income related ESA.
We have contacted ATOS who tell him he is on the waiting list but are unable to tell him when he will be seen. So it is looking likely he will lose his contribution based ESA whilst he awaits to be assessed.
Has anyone else come across this, if so, what do you suggest? Client needs that small amount of money as his partner is on a low income.
Many thanks

Hi,
Welcome to Benefits and Work
If your forum name is also your real name, you may wish to change it to maintain some anonymity.
This can be done quite easily by following the instructions on this FAQ :
My full name is showing, how can I stop it?
Unfortunately we are aware that fresh ESA claimants only entitled to CB ESA are being kept in The Assessment Phase for 12 months or longer.
Hence, their CB ESA payments cease.
I believe that The DWP do have the facility to expedite claimants to a WCA where there are financial difficulties.
As your client's partner is working, they may consider that there are no financial difficulties.
You could ask the DWP DM and/or ATOS whether the feel that they have enough paper evidence to make a decision without a face to face assessment, and maybe provide any added fresh evidence that may support a paper scrutiny decision
Some claimants have benefited from involving their M.P., so that may be worth a try :

Well still no ESA50 form? is anyone else still overdue their form?
On a separate note my hubby was on incapacity benefit (for several years) and moved over to ESA support group, he reaches retirement age mid December and obviously we know his ESA will stop and state pension will kick in!!!, does anyone know is ESA paid in arrears or advance? don't want to ring the DWP.
Any help would be appreciated and also everyone else's position re ESA form.
Many thanks again to the MODs for being a fab support
Best Wishes
