Phoned the DWP this morning as havent received assessors report despite requesting twice on phone and when i sent the template on B & W site template letter requesting a mandatory reconsideration for PIP i and requesting that the assessors report be sent to me as soon as possible and that i would then send in further evidence. Also i pointed out that i was still awaiting a phone call i had been promised within 5 days.
The person i spoke to this morning told me that they were behind with phone calls and sending out assessors report and couldnt telll me when i was likely to receive it as it could take 7-10 days to get to me even when it was sent out and that i should be able to give reasons for consideration because the letter says what i have been given points on and what i havent.
When i asked to speak to a manager i was told it wasnt worth it as they would only say the same as her and if i wanted to make a complaint i had to make one through my M.P.
Is this true?
Also i wondering if i should have sent a SAR in to get the assessors report.
Does anyone know how long i have to get things in for consideration the girl on the phone said that my letter said that they had all the evidence they needed to reconsider but i pointed out that it also said that when i had the assessors report i would send in further response.

It is total rubbish to say that you can only complain via your MP! Mind you, it is true that DWP sometimes pay more attention to the MP than the claimant.

Complaining to ATOS Healthcare

Complaining to the DWP

Contacting your MP

When Mandatory Reconsiderations were first brought in we were told that DWP would aim to have these complated within 2 weeks. I'm sure it won't surprise you to know that we hear of people who have waited months :( The truth is that the longer you take to submit your information, the more likely that you will be too late as a decision has been made. If you had submitted an SAR, DWP would have had 40 days to reply, which is why we don't usually recommend it at this stage. You should concentrate on showing how and why you meet the descriptors rather than just refuting the report.
