incompetent tribunal was created by malcolmthemole
yesterday was my tribunal... 6 months after the start of the process and the end is in sight......

WRONG

my tribunal was 3pm in wigan courthouse...... I got there early.....

At 2.50 I was informed that on return from lunch they had decided that they wanted medical record information AND that I would be adversely affected by the location (I am massively allergic to most things)

I had arrived.... I had paid £4 parking (it takes me longer to get around.....

I WOZ THERE

That is sheer INCOMPETENCE

I have changed NOTHING since the first paperwork (sent in august, seen in november)

It's unfortunate but this is the way that Tribunals operate!

Even though the panel get the papers for an appeal several days in advance of the hearing, they are not usually read until the night before and so matters such as their wanting to see your medical records are not raised until the day of the hearing.

You may have good cause for complaint, as your hearing was in the afternoon there was plenty of opportunity for the Clerk of the Court to contact you about the hearing being adjourned, but this does suppose that the panel made their decision first thing and not at lunch time.

You don't state what benefit your Tribunal was for ? I sat on DLA Tribunals in the North West including Wigan, where I also used to be Principal WRO for Wigan MBC.

It's not uncommon for Tribunals to adjourn for further medical evidence if they feel it will help your appeal.

This not 'incompetence', it is the duty of the Tribunal to adjourn if they are of the opinion that further medical evidence would give you a better chance of winning your appeal.

In fact, Tribunals from my experience are sent your case bundle 2-3 weeks before the date of your appeal in order to give them time to read your case bundle, since most Tribunal Members work part-time on a fee basis and are not employees of the Tribunals Service. In the majority of cases, the Tribunal Panel Members will not meet as a Tribunal until the day your Tribunal is heard.
