I was recently refused ESA. Following the decision, I had a Mandatory Reconsideration which also found me fit for work with no change from the original decision maker..
I have now lodged an appeal with HM Courts and Tribunal Service and have a representative and have also asked for an oral hearing.
I have since sent medical evidence from my GP and consultant/Specialist that backs my claim that I am not fit for work and qualifies for ESA support group.
Can a decision be made by the tribunal before it even reaches the hearing ? or once an appeal is lodged does it have to go to the hearing ??
