ESA TRIBUNAL FROM WRAG TO SUPPORT GROUP

Hello. Firstly I would like to thank you for the resources you provide as I feel they helped a lot in preparing for Tribunal last year.

I was in WRAG in February last year without a medical and appealed to be transferred to Support group, eventually went to Tribunal in November last year, who thankfully found in my favour. This was November last year. It was recommended I am in Support group for two years.

Today is the day the DWP processed this recommendation, three months later. I have recieved a call stating that the difference between feb 2013 to today in the payments will be back paid, this concerned me as I guessed this meant they were classing the two years from Feb 2013 rather than the Nov 2013 tribunal decision. I asked the DWP previous to today is the two years from Nov or Feb and told it was two years from Nov in support group. But today when asking the same question I was told he (DWP decision maker) had interpreted it to be from Feb last year which means I am in support group for one year rather than the two. Is this correct? I would rather be in the support group for two years than have the extra 9 months back pay.

I hope this query makes sense. Thank you.

Congratulations on being placed in the Support Group and thank you for your comments on B&W.

I am afraid the re-assessment date does not form part of the Decision, the DWP can perform a re-assessment at any time after three months have elapsed from the date of a previous Decision.

Any back payments you receive will be from the date of the previous Decision as the Tribunal re-make this Decision at the hearing, as a consequence, any recommended re-assessment period also applies from this date.
