My Husband had his tribunal on 18th Dec after waiting for 19 months, he was so shocked to hear that our appeal was upheld PLUS he will get care allowance at the lower rate that we had to get a wheelchair to get him to the taxi,the disability lady was nasty to him a few times and when she said she had no more questions then asked if he had been on holiday (to which he replied 'what's a holiday'?) you can imagine I think the relief we are feeling now, why people have to beg for what we are entitled to I don't know, we are over the moon on cloud 9 .

Today we had a letter from the DWP asking if he had been in hospital or a care home since July 2012, I am hoping this means they are just checking up that he has been at home all this time, (he has) what do you think? I'm getting a bit worried now that they will find a way not to pay up. Anyone any advice please?


He also has been put on ESA Support after an ATOS Medical but we don't know how long that is for.

Hi Hanert,

That is great news, thanks for letting us know :) It is usual to be asked to provide details of any time spent in hospital, in order to reduce the chance of overpayment, it is not usually anything to worry about.

If you wish to find out when to expect reassessment, you can phone DWP and ask for the 'prognosis' or you can write and ask for a copy of the paperwork associated with the claim. This FAQ is relevant, even if there was no face2face assessment.
