My wife was successful in her appeal for ESA and was placed in the support group.

However this turned out to be a Pyrrhic victory because about a month later my son claimed Carers Allowance which triggered a loss of the Severe Disability Premium, which we were apparently not entitled to from the start of her time in receipt of ESA because our sons live with us.

We had correctly filled in the original ESA application so the DWP fortunately decided that we were not at fault. At least three different DM's had looked at the claim prior to going to appeal and had not spotted the mistake.

My wife, who is in receipt of DLA at the Higher Care Rate receives £213 every two weeks. This equates to Couples allowance and the Support Group premium.
I have just looked at the FAQ's on ESA and it would seem she may also be entitled to the Enhanced Disability premium.

Is his correct and if so if we contact DWP will it be treated as a change of circumstances that may trigger having to go through the assessment process again?

Hi B24c,

Entitlement to The Enhanced Disability Premium (EDP) has two qualifying criteria.

1. You are in The SG of ESA.

2. Taking into account the means test for capital, assets, savings, household income and hours worked by a partner, you are also entitled to payment of Income Related (IR) ESA.

24 hour work rule for ESA(IR)

Asset rule for ESA(IR)

ESA Premiums

You may be required to fill out an ESA 3 Financial Assessment Form to see whether you pass the means test, but this should not trigger a fresh ESA WCA/ESA50 reassessment.

You would have to contact the Benefits Office that deals with your ESA regarding this, if necessary they will post an ESA 3 Form to you.

Sending Documents to the DWP or ATOS

Thank you bro58 for prompt answer.

It looks as though my wife is being paid ESA(CB) the successful Appeal to the support group backdated to before her ESA(CB) 365 days ran out. She was receiving ESA (IR) at the assessment rate. I cannot find the notification letter sent to her when son received carer's allowance so we will write to DWP.

Hi B24c,

It is possible to receive CB ESA with IR ESA top ups (dependent of your personal finances, etc) so it may be worthwhile pursuing this further.
