No question they do Gordon. When you receive a letter stating they (DWP) are unable to do so for legal reasons you sue them, they settle out of court and you have to sign a non disclosure agreement or some such. It's a scam and nothing more.

I, like Gordon, am at a loss to understand what point you are trying to make.

"Suing" organisations is not as straight forward an issue as you imply.

Your posts regarding this are only serving to confuse the issue, in my opinion.

I believe any files are kept by the DWP not Atos so when Atos read your form they do not have access to them. But I could be wrong...?

Yes Pl,

We are led to believe that the ATOS HCP assesses the claimant in a standalone capacity.

Once an assessment has been carried out, all the claimant's files are returned to The DWP, where, on completion of the decision making process, they are then stored in The DWP Data Control Dept in compliance with The Data Protection Act 1998.

The DWP DM, may well have access to previous/other medical reports in the decision making process.
