new evidence submissions and LCWA / LCWRA guides was created by twinkerzzz
Hi
I have a couple of questions regarding medical examinations.
1. If i am called for a LCWA / LCWRA can i present new documentary evidence to the examiner and if so what is the legal requirment for them to follow regarding them taking it, looking at it and retaining it. Is it possible they would stop an examination based on having looked at the submitted evidence ?
2. With regards to both the LCWA and the LCWRA - is there any Benefit and Work resource or third party resource that explains the LiMA questions and provides advice on answering to the same extent you guides detail the ESA50 because i'm finding it difficult to understand what to expect. I'm familiar with your ESA guides and the WCA handbook and the Medical Services update to understanding communication but found these were not about the questions and answers.
3. A question regarding submission of new evidence to Atos.
Atos have has my ESA50 for a long time. (Some 14 weeks.) Since submitting it new documentary evidence has been generated. I know i can send the DWP decision maker new evidence at any time (Please correct me if i am wrong.) But can i send Atos the new evidence as well ? If they saw the evidence they would be obliged to come to a decision and pass the case on to the decision maker without calling me for a medical. But i am unsure if they would receive it by post after the intial submission of my ESA50 back in August. Please advise.
Thanks for your help.

You can present new evidence at your assessment and it may in fact be pertinent to take copies with you for them to refer to. However I have heard of assessors refusing to look at evidence so I would make sure you also send a copy to either Atos or the DWP, or of course if you wish to cover all bases both. It is possible that evidence may void the necessity for a medical if they consider you eligible for the Support Group and so maybe a good idea to send ASAP to Atos, but this is rare.

Just to add to the advice already given.
The claimant bringing documents to the assessment is covered in section 4.2.5 of the WCA Handbook.
There is a guide to the LiMa software in the Members Area, but do not expect too much of it, while it covers many of the questions likely to be asked during the assessment it does not contain any of the programming logic that sits behind them, which is not in the public domain, and is needrd to have any reasonable understanding of how the system works.
It is possible for the interview to be stopped because the assessor believes they have sufficient information to make a recommendation, this would only be where a Support Group award is being considered.

It is not you
I have had a quick look through the Members area and it would appear that the site owner has pulled it, the version available in the public domain is out of date, there has never been a version available that covers the ESA changes since 2011.
I have found a link to v2.0 of the guide which is dated 2004, there may be a later version do a search for "LiMa software guide2, but as I said earlier, without an understanding of the programmming logic, it is not very helpful.
